Terms and Conditions
 

1. Agreement to Terms

By booking services with Charvaka Studios, you agree to be bound by the following Terms and Conditions. These terms apply to all services offered by Charvaka Studios.

 

2. Services Provided

Charvaka Studios offers professional photography services for:

  • Product Photography: High-quality images of products for e-commerce, catalogs, advertisements, and other commercial purposes.

  • Fashion Photography: Photoshoots for fashion brands, clothing, models, magazines, advertisements, and other media.

  • Lifestyle Photography: Candid and styled photoshoots capturing real-life situations for individuals, families, brands, and social media influencers.
     

3. Booking and Payment Terms

  • A booking is confirmed only after the payment of a non-refundable deposit of 30% of the total service fee.

  •  50% of the total service fee must be paid 2 weeks before the scheduled photography session.

  • Remaining fee must be paid after the approval of final deliverables.

  • Payments can be made via [list accepted payment methods such as bank transfer, online payments, etc.].

  • In case of cancellation by the client, the deposit is non-refundable.
     

4. Cancellation and Rescheduling

  • Cancellations must be made at least 7 days in advance of the scheduled shoot to avoid additional charges.

  • If the client wishes to reschedule, this is subject to photographer availability. Rescheduling may incur additional fees.

  • Cancellations made within 3 days before the session will incur a fee of 50% of the total service fee.

5. Client Responsibilities

  • The client is responsible for providing clear details regarding the project, including location, time, and special requirements.

  • For Product Photography, the client must provide all products in a suitable condition for shooting. Any shipping charges for products sent to the studio are the client's responsibility.

  • For Fashion Photography, the client must arrange for models, stylists, and makeup artists unless a separate package is offered.

  • For Lifestyle Photography, the client is responsible for selecting the location (if applicable), and ensuring that the location is accessible, safe, and suitable for the shoot.
     

6. Photography Session and Studio Access

  • The studio provides a comfortable and professional environment for all photoshoots. The client must ensure that any required permissions are obtained for the use of public spaces or private property.

  • Product Photography: Clients are required to deliver all items well in advance of the shoot.

  • Fashion Photography: The client agrees to provide necessary styling, makeup, and hair artists unless specifically included in the service.

  • Lifestyle Photography: The studio will make reasonable efforts to suggest locations for lifestyle shoots, but the final location must be confirmed in advance.

7. Image Rights and Copyright

  • All photographs taken by Charvaka Studios remain the intellectual property of the studio.

  • The client is granted a non-exclusive, non-transferable license to use the images for personal, marketing, or commercial purposes, as agreed upon prior to the session.

  • Fashion and Lifestyle Photography images may be used by the studio for promotional purposes, including social media, portfolios, and websites. If the client does not agree, this should be specified in writing before the session.

  • Product Photography: If the client intends to use the photos for commercial purposes (e.g., for advertisements or e-commerce), the client agrees to provide proper credit or terms for such usage.
     

8. Image Delivery and Post-Processing

  • The estimated delivery time for final images is 2 weeks after the photography session.

  • Images will be delivered in [digital format, e.g., online gallery, USB, etc.].

  • The final number of images depends on the type of service.

  • Basic retouching, color correction, and minor cropping are included in the service. Any additional retouching or extensive alterations will incur an additional fee.

9. Additional Charges

  • Any additional requests, such as extra hours of shooting, custom styling, extensive retouching, or special equipment (e.g., props, backdrops), will incur extra charges.

  • For Product Photography, shipping fees for products (if applicable) are the client's responsibility.
     

10. Liability

  • Charvaka Studios is not liable for any personal injury, property damage, or loss occurring during the photoshoot.

  • In the event of equipment failure or unforeseen circumstances that prevent the studio from completing the shoot, the studio will offer a rescheduled session or a refund of the deposit in customer's bank account within a week of cancelling of the services, but will not be liable for any additional losses.
     

11. Force Majeure

  • The studio will not be held responsible for delays or cancellations caused by circumstances beyond its control, such as natural disasters, acts of government, or other force majeure events.
     

12. Confidentiality and Privacy

  • All information provided by the client for the session will be kept confidential. However, the studio may use the images for marketing and promotional purposes unless the client explicitly requests otherwise in writing.
     

13. Dispute Resolution

  • In the event of any dispute regarding the Terms and Conditions or the photography services, both parties agree to attempt mediation first.

  • If mediation fails, the dispute will be resolved through arbitration under the laws of India, and the courts in Gurugram, Haryana will have exclusive jurisdiction.
     

14. Governing Law

  • This agreement shall be governed by and construed in accordance with the laws of India.
     

15. Amendments

  • Charvaka Studios reserves the right to amend or update these Terms and Conditions at any time. The client will be informed of any significant changes in advance of the photography session.
